The fundamental confusion stems from the conflation of contract architecture with exchange implementation. Features such as high leverage, auto-deleveraging (ADL), and around-the-clock trading are not inherent to the perpetual futures contract itself but are instead design decisions made by crypto exchanges to optimize user experience and capital efficiency. Wilson emphasized that these operational characteristics are variable and platform-dependent, whereas the underlying legal and economic structure of a perpetual future remains constant regardless of the venue. Recognizing this separation is essential for accurate product classification.
Regulatory frameworks in the United States are currently grappling with how to categorize these instruments, with debates centering on whether they fit within existing futures or swaps frameworks. As interest in bringing perpetual futures into regulated U.S. markets intensifies, several entities have explored launching these products for traditional assets. Kalshi, for instance, witnessed an explosion in perpetual trading volume shortly after its launch and has recently submitted a proposal to regulators to expand its offerings to include precious metals. This expansion highlights the growing demand for non-expiring contracts across diverse asset classes.
Technological disparities between crypto venues and traditional clearinghouses further complicate the regulatory landscape. Exchanges like Hyperliquid operate continuously, utilize digital collateral, and possess the infrastructure to calculate margin requirements in real time. These capabilities enable the offering of products with higher leverage and alternative liquidation mechanisms, including ADL, which automatically reduces winning positions when losing traders fail to cover their deficits. Wilson argues that these technological advantages should not be mistaken for the definition of the contract itself, but rather viewed as enhancements to risk management and capital efficiency.
Wilson explicitly criticized the use of ADL, stating he is "not a fan" and that there is "no reason it needs to be used for perps." He proposed that digital payment rails offer superior opportunities for risk management compared to traditional methods. Traditional clearinghouses typically calculate margin once a day, allowing participants until the following business day to post additional collateral, which necessitates large initial margin buffers to account for potential market moves. In contrast, real-time settlement allows exchanges to recalculate margin continuously and demand immediate collateral, reducing upfront requirements while maintaining protection levels. This efficiency is a function of technology, not contract type.
The true economic innovation of perpetual futures, according to Wilson, lies in their ability to eliminate the need for investors to repeatedly roll expiring contracts. This structure significantly reduces transaction costs, market impact, and roll slippage, allowing positions to track the front of the futures curve more closely. He urged regulators to focus on economic substance rather than legal labels, arguing that there is 'no reason to treat perpetuals as swaps simply because they don't expire."
