The U.S. Department of Justice and the Commodity Futures Trading Commission have officially jointly filed a request with a federal court, requesting that Arizona refrain from taking action against the Kalshi platform based on its state gambling regulations.

Regulatory authorities emphasized that the betting contracts traded on this platform fall within the category of swap contracts defined by the Commodity Exchange Act, and therefore should be under the exclusive jurisdiction of the CFTC rather than state enforcement.

This legal intervention aims to prevent states from incorrectly applying local laws to federally regulated financial derivatives markets, thereby avoiding substantial overlaps and conflicts in judicial jurisdiction.

If the court approves this request, Arizona will not be able to extend its anti-gaming regulations to such transactions, which are deemed legal financial contracts. This directly affects the operational legitimacy of platforms like Kalshi in key states.
